Abstract

Examines the authority of U.S. President George W. Bush to conduct military affairs for the national security of the U.S. in the state of war. Response of the administration of Bush to the claims of the foreign nationals who were captured in Afghanistan and imprisoned at the U.S. base in Guantánamo Bay, Cuba; Issue on the rights of U.S. citizens in the case of Yaser Esam Hamdi and José Padilla who were designated as enemy combatants by the U.S. government; Precedents used by Bush as a basis for his decisions in the case of Hamdi, Padilla and the prisoners in Cuba.
